If parents in Pakistan cannot agree on custody terms, the Family or Guardian Court intervenes. The court first attempts reconciliation or mediation. If that fails, it proceeds to a formal trial where both sides present evidence. Custody decisions are based solely on the child’s welfare, including age, care history, and the child’s preference (if mature). The court may issue interim orders and later a final custody ruling, which can be appealed.
