The sales of full body massage services in Newcastle are taxable even if you're a registered massage therapist under Title VIII of the Education Law according to an analysis by the New York State Comptroller's Office. The city tax in Newcastle does not apply to massage services that are provided by an authorized massage therapist, registered nurse or dermatologist for medical reasons. The reason is that massage is classified as an entertainment activity under the law. Comptroller Thomas P. DiNapoli is the state's comptroller of the state. He stated that "masseuses and other providers of adult intimate treatment are tax-exempt under the law when they provide their services for profit." DiNapoli said that while many New Yorkers are interested in massage therapy, a majority do not use therapeutic massage to ease tension, muscle pain, or stress, so massage providers are not exempt from city sales taxes.
