The government moved for dismissal for lack of jurisdiction of the good faith violation because this was not presented to the contracting officer. The Board disagreed, finding that there was jurisdiction. The Board also disagreed with OPM?s argument on the breach of contract claim?finding that the contract itself express stated that the Contract Disputes Act governs any disputes arising from the contract.
