1) ESD has a history of bad decisions and has been sued many times. After several court losses, ESD argued that it should be immune from further prosecution. The school said that religious schools should not be liable for claims of child abuse and mistreatment because the doctrine of the separation of church and state prevents such claims. In other words, schools can do as they please without interference from any government court. The old, white, male and very religious appellate court agreed with them and now the law at least in Texas is that child abuse and mistreatment by religious schools is no longer a crime.
