In New York, divorce is governed by "irretrievable breakdown" or fault grounds. To file for a no-fault divorce, spouses must assert that their marriage has been irretrievably broken for at least six months, and attempts at reconciliation have failed. Alternatively, fault-based grounds include adultery, abandonment, cruel and inhuman treatment, or imprisonment for three consecutive years.
